At Philippine Mining Service Corporation (“PMSC”), your privacy is important to us.

At PMSC (which is also referred to as the “Company”, “we”, “us” and “our” hereinafter)we value your privacy such that we ensure that appropriate measures are in placeto protect your data and that such measures are reflected in every process where your personal data is involved. Said measures are implemented through our information security management system and Privacy Statement that are established in accordance with the principles of proportionality, transparency, and legitimate purpose.

This Privacy Statement answers the questions and then explains:

  1. Who are the data subjects whom we collect personal information from?
  2. What information are collected and how these will be collected?
  3. How your personal data will be used, disclosed, shared, retained and disposed?
  4. How to view, change, remove or withdraw personal data and all that involves in exercising your rights under the law.

APPLICATION OF THIS PRIVACY STATEMENT

This Privacy Statement applies to the following individuals or entities who are or may be engaged or dealing with our Company:

  1. Applicant – one who has interest in applying for an internship or employment in the Company. PMSC collects information when one applies for employment. Among other, PMSC may ask for one’s personal data including copies of resume or biodata or curriculum vitae, and any other information required to verify one’s representations and qualification.
  2. Employee – one who works under an employment contract with the Company. PMSC collects his or her personal data as part of its pre-employment and employment processes.
  3. Agency personnel or contractor’s assigned personnel – PMSC may ask the employer-contractor or agency to submit the personal information of their assigned employees.
  4. Vendor – an entity or company who occasionally renders work or services to the Company under a contract. PMSC collects personal data from the supplier’s business cards or contract entered to.
  5. Visitor – one who visits the Head Office and plant sites other than employees and applicants. PMSC collects personal data through the proof of identity or documents provided during the security check. If through the website, the Company collects data as provided in the Contact Us page.

PERSONAL INFORMATION COLLECTED

If you are an Applicant, personal data that we may collect includes, but are not limited to, the following:

  1. Name, gender, age, date of birth, ethnicity, civil status and place of birth;
  2. Photographs;
  3. Permanent address, present address; telephone numbers, mobile numbers, email address and other contact details;
  4. Resume, educational qualifications, professional qualifications and certifications, and employment references;
  5. Employment and training history; and
  6. Work-related health information, issues and disabilities.

If you are an Employee, personal data that we may collect includes, but are not limited to, the following:

  1. Name, gender, age, date of birth, ethnicity, citizenship, civil status, religion and government IDs;
  2. Photographs;
  3. Permanent address, present address, telephone numbers, mobile number, email address and other contact details
  4. Details of your child/children, parents, spouse and other family members;
  5. Salary information, taxes and bank account details;
  6. Work-related health information, issues and disabilities;
  7. Records on leave of absence from work;
  8. Performance assessments and disciplinary records; and
  9. Any additional information you may provide to us as an applicant (that is, prior to being engaged as an employee)

If you are a Vendor, personal data that we may collect includes, but are not limited to, the following:

  1. Name, gender, age, date of birth, and ethnicity;
  2. Photographs;
  3. Permanent address, present address, telephone numbers, mobile number, email address and other contact details;
  4. Certifications and other information;
  5. Project history;
  6. Registration requirements; and
  7. Any additional information provided to us by you as a Vendor.

If you are a Visitor, personal data that we may collect includes, but are not limited to, the following:

  1. Name, age, date of birth, nationality, religion, and government ID;
  2. Company name, permanent and office address, contact numbers, email address and other contact details.

USE OF COOKIES

Our website (www.pmsc.com.ph) makes use of cookies, which may be set by our webserver or provided by a third party. These are small text files that are automatically downloaded to your browser upon visiting our site to help us identify you and generate metrics concerning your visits and interactions on our website.

COLLECTION, USE AND DISCLOSURE

If you are an Applicant, your personal data will be collected and used and may be disclosed to government authorities and third parties as may be necessary for the following purposes:

  1. Verifying your identity and the accuracy of the personal information provided;
  2. Assessing your suitability for internship or employment with the Company; and
  3. Compliance with applicable laws and rules and regulations

If you are an Employee, your personal data will be collected and used and may be disclosed to government authorities and third parties as may be necessary for the following purposes:

  1. Performing obligations under your contract of employment;
  2. Administrative and human resources related matters of the Company;
  3. Managing and terminating our employment relationship with you;
  4. Assessing your suitability for employment or continued employment and/or appointment in any position within the Company; and
  5. Processing our compliance with any applicable laws and rules and regulations.

If you are a Vendor, your personal and business information will be collected and used and may be disclosed to government authorities and third parties as may be necessary for the following purposes:

  1. Performing obligations under the contract or agreement;
  2. Managing and terminating your contract with us; and
  3. Processing our compliance with any applicable laws and rules and regulations.

If you are a Visitor, your personal information will be collected and used and may be disclosed to third parties as may be necessary, to manage and facilitate a smooth visit to Head Office and/or plant sites, or to comply with applicable laws and rules, and regulations.

PROVISION TO THIRD PARTY

PMSC will not furnish or transfer specific personal data collected to third parties, except in limited circumstances or instances as are provided by laws or ordinances.

STORAGE AND RETENTION

Records of personal data are stored and retained in our secured database and storage facilities. Physical security measures are implemented to safeguard hard copies and hardware containing personal data, and only authorized personnel shall have access to such information. The Company will retain personal data only for as long as it is reasonably necessary for the declared purpose and/or in compliance with legislative and/or regulatory requirements.

KNOW YOUR RIGHTS

As subject of the data we collect and process, it is important that you are aware of your rights provided under the Data Privacy Act of 2012 and that you are provided with a convenient way to exercise those rights:

  • Be informed. You have the right to be notified and furnished with information before your personal data enter our processing system.
  • Object. You have the right to object to the processing of your personal data and/or withdraw your consent in case of changes in the data previously provided. In such event, your personal data shall no longer be processed, except in instances enumerated under the law.
  • Access. You have the right to access or demand access to view of practically everything that will happen to your personal data, which includes but are not limited to the description of the personal data, purpose, collection process, use, distribution, disclosure, storage, disposal and destruction.
  • Rectify. You have the right to dispute, under reasonable circumstances, the inaccuracies or errors in your personal data and have the same corrected immediately and accordingly.
  • Erase or block. You have the right to suspend or withdraw, order the blocking, removal or destruction of your personal data from our filing system upon discovery and substantial proof of the conditions enumerated under the law.
  • Be indemnified. You have the right to receive compensation for any proven damages you may have sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of your personal data.
  • Data Portability. You have the right to obtain a copy of electronically processed personal data in an electronic or structured format commonly used. This right highlights the concept that you, being the data subject, have control over your personal data.
  • To file a complaint. You have the right to file a complaint with the NPC if personal data has been misused, maliciously disclosed, or improperly disposed, or if any of your data privacy rights has been violated.

HOW TO EXERCISE YOUR RIGHTS

One of our main objectives is to provide you with a convenient way to access your personal data and exercise your rights under the law. If you wish to exercise any of your rights, you may contact our Data Protection Officer. Note, however, that changes and deletion of your personal information from our records shall only be done if within justifiable means and cause. To protect information from malicious or accidental destruction, residual copies from active servers and records found in backup system may not be immediately deleted.

UPDATES & REVISIONS

Any updates or revisions to our policies relating to privacy and security of your personal data shall be published on this Privacy Statement and any major changes or improvements shall be separately communicated and highlighted but, nevertheless, shall still be included on this statement.
